Every user of the ARGUS website acknowledges the following conditions:


1. ARGUS information does not represent legal offers the information provided on the website of Argus der Presse AG (hereinafter "ARGUS") does not constitute an offer but serves for the purposes of general information. If ARGUS wishes to publish an invitation to tender an offer or to exceptionally make a binding offer on the website, ARGUS shall declare this explicitly. Unless there is a specific note that a legal offer is being made, the user of the website (hereinafter "User") shall assume that ARGUS does not wish to make a binding offer. Only agreements concluded separately between the User and ARGUS are binding.

2. No assurances and/or guarantees for information published on the website ARGUS makes every effort to ensure that the information is correct at the point in time at which it is published. ARGUS does not, however, offer any assurances nor assumes any guarantee with regard to the completeness and correctness of content (reliability) of the information. ARGUS reserves the right to amend and update the products, services and price-lists described on the website at any time without prior notice.

3. Exclusion of liability ARGUS assumes no liability for the flawlessness of the functions on the website, nor for the correction of deficiencies in the case of errors. ARGUS also assumes no liability for the website and/or the relevant server being free from harmful elements. Furthermore, ARGUS assumes no liability for direct or indirect damage of a material or imagined nature which could be caused by access to this website and its content and/or links to other websites and their contents as well as the use or non-use of this information and/or the use of deficient and incomplete information from this website and/or other websites linked thereto. ARGUS also excludes all liability for consequential damages as well as any damages caused by auxiliary persons and third parties assigned by ARGUS.

4. Data protection ARGUS regards the security of person-related data of the user, such as the name, address, telephone number or e-mail address and the protection of his/her private sphere as an important matter. For this reason, ARGUS conducts its web activities in compliance with data protection legislation.

4.1. Person-related data Without the approval of the user, ARGUS does not gather any person-related data whatsoever via this website. The user of the website decides him- or herself whether he or she wishes to provide such data to ARGUS within the framework of a query or a registration. The person-related data gathered with the approval of the user is used by ARGUS in particular to answer queries or to enable access to special information or offers. For the cultivation of client relationships, it may become necessary for ARGUS to store person-related data in order to react in a better way to the wishes of clients or to improve the products and services of ARGUS or to provide the clients with news. ARGUS will not communicate person-related data to third parties, nor market such data in any other way. The user can at any time withdraw his or her given approval for the recording, processing and use of person-related data with effect for the future. If the user provides ARGUS with person-related data (e.g. in a request for product information or a query), he or she has the possibility at any time to have the approval for use of his or her data deleted by sending an e-mail to mail@argus.ch. After receiving the notice of withdrawal of approval, ARGUS will make no further use of the relevant data.

4.2. Automatically gathered information which is not person-related data Occasionally when the website is accessed, information is gathered automatically (i.e. not by means of registration), which cannot be allocated to a specific person (e.g. Internet browser used and operating system; Domain name of the website visited previously; Number of visits; Average time spent on the website; Pages called up). ARGUS uses this information in order to assess the attractiveness of its website and to enhance its content.

4.3. Security Measures are undertaken to guarantee the security of the person-related data. The data is conscientiously protected against loss, destruction, falsification, manipulation and unauthorized access or unauthorized disclosure. The security measures are constantly improved in tune with technological development. This means that ARGUS stores the personal details in protected systems in Switzerland. Access thereto is possible for only a few authorized persons who are involved in the technical or editorial care of the systems. The user is expressly made aware that for technical reasons, in the case of transmission of information, e.g. by means of an unencrypted or inadequately encrypted e-mail (or form), it is not possible to guarantee fully comprehensive data protection. It can therefore not be excluded that data might become lost en route or be able to be accessed by third parties. The online communication of personal data therefore takes place at the user's own risk.

4.4. Cookies Cookies are small text files which are used for example in an online forum, guest-book or in contact forms in order to store the access data of the registered users during a session. Cookies are not programs. Cookies can be suppressed in that the browser is configured so that it rejects cookies or the user receives a message if a cookie is meant to be stored on the hard-disk.

5. No responsibility of ARGUS for linked websites Certain links on the website lead to the websites of third parties. These are beyond the influence of ARGUS. ARGUS assumes no responsibility whatsoever for the correctness, completeness and legality of the content of such websites, nor for any offers and supplies of goods/services included therein.

6. Copyrights The contents and the structure of this website are protected by copyright. The full or partial reproduction, distribution by electronic or any other means, modification, linking or use for commercial or public purposes requires the prior written approval of ARGUS.

7. Restrictions of use and refusal of access This website is not intended for persons who are subject to a legislation which forbids publication and/or access to the ARGUS website due the nationality of the relevant persons, their domiciles or for any other reason. Persons who are subject to such restrictions are forbidden from accessing the ARGUS website. The user must additionally note the following obligations in his or her use of the ARGUS website:

Persons, in particular those who are underage, may not be harmed in any way and personal rights may not be infringed;
In the manner of usage, legal stipulations may not be violated, in particular through criminal or immoral behaviour;
Commercial protective rights and copyrights or any other property rights may not be infringed;
No content may be transferred which includes viruses, so-called "Trojan Horses" or other forms of programming which could damage the software;
No links or contents may be entered, stored or sent for which the user is not authorized;
No advertising, unsolicited e-mails or hoax warnings of viruses and similar material may be distributed.
ARGUS rejects any liability for damage which could be caused by violation of the above-mentioned obligations of use.

8. Place of jurisdiction and applicable law The place of jurisdiction for any disputes is exclusively at the ordinary courts at the domicile of ARGUS in Zurich (Switzerland). Swiss law is applicable, particularly the Swiss Code of Obligations.
